LAS VEGAS -- A woman convicted of the 1995 murder of the father of her child has been granted a new trial.

Barbara Pinkston was convicted of shooting and killing Gregory Payne in 1995 in front of a Henderson Discovery Zone, a play center for children. Payne was having a Father's Day visit with the couple's child.

According to court documents, Pinkston said she fired after an argument because she thought Payne was going for a weapon in his truck.

The pair had a rocky relationship. Payne was convicted of a domestic battery charge after a fight with Pinkston.

The U.S. District Court ruled Wednesday that jury instructions did not properly allow the jury to consider a lesser charge of second degree murder. If the prosecution does not re-file charges or work out a deal, Pinkston could be released from jail within 30 days.
